Custom Book Terms & Intellectual Property Policy
These terms explain what a custom-book client receives, what remains LumiNest property, and how digital delivery and optional printing work.
1. Digital custom-book service
The standard LumiNest custom-book service is a digital creative service. The agreed project may include a custom story, illustrations, page design, cover design, and a finished digital book file. Physical printing is not included unless separately quoted and accepted.
2. LumiNest intellectual property
All pre-existing LumiNest characters, names, character designs, illustrations, stories, logos, settings, visual elements, and other original LumiNest materials remain the property of their respective rights holder(s). Purchasing a custom book does not transfer ownership of LumiNest intellectual property.
3. Client usage license
Unless a separate written license says otherwise, the delivered custom book is licensed for the client’s personal and family use. The client may keep, read, display privately, and make reasonable personal-use copies of the delivered book.
4. No resale or commercial reuse
The client may not resell, sublicense, publish for commercial gain, merchandise, extract and reuse illustrations, create derivative commercial products, register, claim ownership of, or otherwise commercially exploit LumiNest characters or LumiNest-owned artwork without separate written permission.
5. Newly created custom characters
If LumiNest creates a completely new character specifically for a client, the ownership and permitted uses of that character will be stated in the project quote or written order confirmation. No transfer of copyright or commercial rights should be assumed unless it is expressly written.
6. Client-provided materials
The client confirms they have permission to provide any names, photos, reference images, text, or other materials supplied for the project. Client materials remain the client’s materials. They are used for producing the requested book subject to the project’s privacy and production needs.
7. Child images and personal details
Where a parent or guardian supplies a child’s photo or personal details, the client confirms they are authorized to do so. LumiNest does not gain ownership of the child’s identity or photograph by using it to produce the requested custom work.
8. Revisions and approval
The project quote may include a stated number of revision rounds. Additional revisions or major changes after approval may require a new quote. Final delivery follows the client’s approval of the agreed version.
9. Pricing and payment
Custom-book pricing depends on project scope, page count, illustration complexity, character design requirements, personalization, revision requirements, and delivery format. A request form is not a purchase. Work begins only after the project scope, price, payment terms, and schedule are confirmed.
10. Optional printing
Printing is an add-on service, not part of the standard digital-book price. Printing, binding, quantity, shipping, customs, taxes, and delivery costs may vary and are quoted separately before any print order is placed.
11. Portfolio use
LumiNest will not treat a child’s private identifying information as promotional material. Any public portfolio or marketing use of a highly personalized book should be handled only with appropriate permission and with sensible privacy protection.
12. Acceptance
Submitting a custom-book request with the terms checkbox selected confirms that the client has read and accepts these service and intellectual-property principles. The final project quote or written agreement may add project-specific terms.
